1. General Provisions
1.1. These terms and conditions of this online store (hereinafter – the Terms) are a legally binding document for the Buyer and the Seller (hereinafter – the Seller), which sets out the rights and obligations of the Parties.
1.2. The Seller reserves the right to amend, correct, or supplement these Terms at any time. The Buyer will be informed about changes to the Terms on the online store’s website.
1.3 Special (themed) belts or keychains are belts or keychains made from materials or design elements marked with third-party trademarks (e.g., Subaru or Dayco), or featuring an exclusive, limited-availability design.
2. Conclusion of the Purchase-Sale Agreement
2.1. The purchase-sale agreement between the Buyer and the Seller is considered concluded when the Buyer places an order for goods in the online store, having first familiarized themselves with these terms.
3. Seller’s Rights
3.1. In the event of significant circumstances, the Seller may temporarily or permanently suspend the operation of the online store without prior notice to the Buyer.
3.2. If the Buyer attempts to harm the operation, stability, or security of the online store or violates their obligations, the Seller has the right to restrict or suspend their access to the online store without warning.
4. Seller’s Obligations
4.1. The Seller undertakes to provide access to the services of the online store, the operating conditions of which are set out in these Terms.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer using the delivery method chosen by the Buyer, based on the conditions set out in these Purchase-Sale Terms.
4.3. If, due to unforeseen circumstances, the Seller cannot deliver the goods ordered in the online store, the Seller has the right to terminate the Purchase-Sale Agreement after informing the Buyer. The Seller may offer an analogous product. If the Buyer refuses, the Seller undertakes to refund the paid money within 3 business days.
4.4. If the Buyer exercises the right provided in clause 5.2 of the Terms, the Seller undertakes to refund the money paid by the Buyer within 5 (five) business days from the date of receipt of the returned goods.
4.5. The Seller may withhold reimbursement until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been sent back to the Seller, whichever occurs first.
5. Buyer’s Rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Terms.
5.2. The Buyer has the right to withdraw from the purchase-sale agreement concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may exercise the right discussed in clause 5.2 only if the goods have not been damaged or their appearance has not substantially changed, and if they have not been used.
6. Buyer’s Obligations
6.1. The Buyer must pay for the purchased goods and accept them in the manner specified in these Terms.
6.2. If the Buyer, without valid reasons, refuses to accept the goods at the time of delivery, the Buyer must cover the return costs of the goods if requested by the Seller.
6.3. Upon delivery of the goods to the Buyer, the Buyer must check the condition of the shipment and the item(s) together with the Seller or the person who delivered the shipment.
6.4. By using the online store, the Buyer confirms that they agree to these purchase-sale terms and must comply with them.
7. Product Prices
7.1. Product prices in the online store are indicated in euros. Prices include VAT. After confirming the order, a delivery fee will be added to the total amount of goods, if applicable.
8. Product Ordering and Payment
8.1. The Buyer, upon visiting the online store, selects the desired goods and adds them to the shopping cart. After forming the shopping cart, the Buyer enters personal data necessary for order fulfillment: their name, surname, delivery address, phone number, and additional information that may be important for delivering the ordered goods. The Buyer confirms that they have read these terms and confirms the order.
8.2. Payment can be made using Swed, Seb, Luminor, Citadele, Šiaulių bankas electronic banking services, and Visa / MasterCard payment cards. Payments are accepted in euros. Payments are processed using the MakeCommerce.lt payment platform.
9. Product Delivery
9.1. When ordering goods, the Buyer must specify the exact delivery address.
9.2. The Buyer must accept the goods themselves. If the Buyer cannot accept the goods themselves, but the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims regarding the delivery of goods to an unsuitable person.
9.3. The Seller delivers the goods to the Buyer according to the terms specified in the product descriptions.
9.4. The characteristics of all sold goods are indicated in the description accompanying each product. The Seller is not responsible if the color, shape, or other parameters of the goods in the online store do not match the actual size, shape, and color of the goods due to the characteristics of the Buyer’s monitor.
9.5. If the Buyer withdraws from the purchase-sale agreement, the Buyer will be refunded the full amount paid for the goods, excluding the delivery costs paid by the Buyer.
10. Product Returns
10.1. Quality goods may be returned within 14 days from the date of their receipt. Defects of sold non-quality goods are rectified, non-quality goods are exchanged, or returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be observed when returning goods:
10.2.1. The returned item must be in its original, undamaged packaging (this point does not apply when returning a non-quality item);
10.2.2. The item must not be damaged by the Buyer;
10.2.3. The item must be unused and retain its commercial appearance: labels intact, protective films not removed, etc. (this point does not apply when returning a non-quality item);
10.2.4. The returned item must be of the same completeness as received by the Buyer (this point does not apply when returning a non-quality item);
10.2.5. The Seller has the right to refuse to accept goods returned by the Buyer if the conditions for returning goods have not been complied with;
10.2.6. Goods are returned in the manner determined by the Seller within 14 (fourteen) days from the date of receipt of the goods (this point does not apply when the item is of non-quality – in such a case, goods are returned within the statutory warranty period);
10.3. The return and exchange of quality goods are carried out in accordance with Article 6.22810, Part 1 of the Civil Code;
10.4. Money paid for goods accepted by the Buyer but later refused will be refunded to the Buyer’s account no later than 5 (five) days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.
10.5 Special (themed), sewn, and riveted belts, due to their individual characteristics and limited sales potential, are considered custom-made goods and are not returnable or exchangeable, except in cases where quality defects are identified.
11. Final Provisions
11.1. These Terms are drawn up in accordance with the legal acts of the Republic of Lithuania.
11.2. These Terms and the relationships between the Parties regarding these Terms are governed by and interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disputes arising from the execution of these Terms shall be resolved through negotiations. If an agreement cannot be reached, disputes shall be resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties are released from their obligations under these Terms if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force Majeure).
11.5 All third-party trademarks used on belts or keychains belong to their rightful owners. These marks are used solely for product identification or design description purposes. The Seller is not affiliated with, sponsored by, or an official representative of the aforementioned trademark owners.
